CLAUSE 1 — ACCEPTANCE OF TERMS AND LEGAL APPLICABILITY

  • BY MAKING ANY PAYMENT, BOOKING, OR USING ANY SERVICE OF “THE TREKKERS TRAIL,” THE CLIENT FULLY ACCEPTS AND AGREES TO ALL TERMS AND CONDITIONS LISTED HEREIN.
  • THE TERMS PUBLISHED ON WWW.THETREKKERSTRAIL.COM ARE THE ONLY VALID AND LEGALLY BINDING TERMS.
    WHATSAPP CHATS, CALLS, SOCIAL MEDIA MESSAGES, OR VERBAL STATEMENTS SHALL NOT BE CONSIDERED AS AGREEMENT, PROMISE, OR COMMITMENT.
  • FAILURE TO READ THESE TERMS DOES NOT EXEMPT THE CLIENT FROM LEGAL RESPONSIBILITY.
  • THE COMPANY MAY MODIFY OR UPDATE THESE TERMS AT ANY TIME WITHOUT PRIOR NOTICE.

CLAUSE 2 — BOOKING WINDOW, PAYMENT STRUCTURE, AND PRICE POLICY

2.1 BOOKING DEADLINE

  • ALL BOOKINGS MUST BE COMPLETED AT LEAST 7 DAYS BEFORE DEPARTURE.
  • AFTER THIS DEADLINE, BOOKINGS WILL NOT BE ACCEPTED.

2.2 BOOKING CONFIRMATION

  • A BOOKING IS CONFIRMED ONLY AFTER:
    • THE CLIENT PAYS THE 25% NON-REFUNDABLE BOOKING AMOUNT
    • THE COMPANY SENDS A WRITTEN CONFIRMATION EMAIL FROM INFO@THETREKKERSTRAIL.COM
  • NO OTHER CONFIRMATION METHOD IS VALID.

2.3 PAYMENT STRUCTURE

  • 25% BOOKING AMOUNT IS MANDATORY AND NON-REFUNDABLE
  • REMAINING 75% MUST BE PAID 7 DAYS BEFORE DEPARTURE
  • FAILURE TO PAY THE BALANCE RESULTS IN:
    • AUTOMATIC CANCELLATION
    • COMPLETE LOSS OF ALL PAID AMOUNTS
    • NO RESCHEDULING
    • NO COMPENSATION

2.4 PRICE VALIDITY

  • TRIP PRICES MAY CHANGE DURING PEAK SEASON OR HIGH DEMAND WITHOUT NOTICE.
  • CLIENT MUST CONFIRM THE CURRENT PRICE BEFORE BOOKING.

CLAUSE 3 — CANCELLATION, REFUND, AND NON-REFUND RULES

3.1 CANCELLATION AFTER FULL PAYMENT

  • IF FULL PAYMENT IS COMPLETED, REFUNDS APPLY AS FOLLOWS:
    • MORE THAN 30 DAYS BEFORE DEPARTURE — 90% REFUND
    • 21 TO 29 DAYS BEFORE DEPARTURE — 75% REFUND
    • 15 TO 19 DAYS BEFORE DEPARTURE — 50% REFUND
    • 14 DAYS OR LESS — NO REFUND UNDER ANY CIRCUMSTANCE

3.2 CANCELLATION BEFORE FULL PAYMENT

  • IF FULL PAYMENT WAS NOT COMPLETED, ALL PAID AMOUNTS ARE 100% NON-REFUNDABLE.

3.3 NO REFUND CONDITIONS

  • NO REFUND WILL BE GIVEN FOR:
    • PERSONAL REASONS
    • MEDICAL ISSUES
    • OFFICE/WORK ISSUES
    • TRAVEL DELAYS
    • ROADBLOCKS
    • WEATHER CONDITIONS
    • PERMIT DENIAL
    • FORCE MAJEURE
    • FAILURE TO ARRIVE ON TIME
    • MISBEHAVIOR OR RULE VIOLATION
    • FAILURE TO MEET FITNESS REQUIREMENTS

3.4 FORCE MAJEURE

  • IN CASE OF NATURAL EVENTS, WEATHER, DISASTER, GOVERNMENT ORDERS, OR ANY UNCONTROLLABLE EVENT:
    • NO CASH REFUND
    • A VOUCHER OR DATE CHANGE MAY BE PROVIDED ONLY IF FEASIBLE

3.5 ZERO EXCEPTION POLICY

  • NO EXCEPTIONS, NEGOTIATIONS, OR SPECIAL CONSIDERATIONS WILL BE ENTERTAINED UNDER ANY CIRCUMSTANCE.

CLAUSE 4 — OFFICIAL COMMUNICATION POLICY (EMAIL ONLY)

  • ALL OFFICIAL COMMUNICATION MUST BE MADE EXCLUSIVELY THROUGH:
    INFO@THETREKKERSTRAIL.COM
  • WHATSAPP, CALLS, OR SOCIAL MEDIA MESSAGES ARE NOT CONSIDERED VALID.
  • ALL EMAILS MUST BE SENT FROM THE CLIENT’S ORIGINAL REGISTERED EMAIL ID ONLY.

CLAUSE 5 — NON-TRANSFERABILITY AND IDENTITY RESTRICTIONS

  • ALL BOOKINGS ARE STRICTLY NON-TRANSFERABLE.
    THE CLIENT’S NAME, BOOKING, SLOT, OR DETAILS CANNOT BE CHANGED, REPLACED, OR SHIFTED TO ANOTHER PERSON OR ANOTHER BATCH.
  • ANY ATTEMPT TO TRANSFER BOOKING WILL RESULT IN IMMEDIATE CANCELLATION WITHOUT REFUND.

CLAUSE 6 — RESCHEDULING AND MODIFICATION POLICY

  • ONLY ONE RESCHEDULING REQUEST IS ALLOWED
  • REQUEST MUST BE MADE MORE THAN 10 DAYS BEFORE DEPARTURE
  • A 25% RESCHEDULING FEE APPLIES
  • RESCHEDULING WITHIN 10 DAYS IS NOT ALLOWED
  • IF THE COMPANY RESCHEDULES A TRIP:
    • A 12-MONTH NON-TRANSFERABLE VOUCHER WILL BE PROVIDED
    • NO CASH REFUND WILL BE ISSUED

CLAUSE 7 — GROUP SIZE AND OPERATIONAL POLICY

  • TO MAINTAIN PREMIUM EXPERIENCE:
    • TREKS ARE LIMITED TO 6–10 TREKKERS
    • BACKPACKING TRIPS ARE LIMITED TO 6–12 TRAVELERS
  • IF MINIMUM GROUP SIZE IS NOT MET, THE COMPANY MAY COMBINE GROUPS OR RESCHEDULE.
  • A VOUCHER WILL BE PROVIDED. NO CASH REFUND.

CLAUSE 8 — PARTICIPANT CONDUCT, SAFETY, AND REMOVAL POLICY

  • IMMEDIATE REMOVAL WITHOUT REFUND WILL OCCUR FOR:
    • MISBEHAVIOR
    • ABUSE OR THREATS
    • ALCOHOL/DRUG USE
    • HARASSMENT
    • UNSAFE ACTIONS
    • DISRESPECTING STAFF/LOCALS
    • IGNORING SAFETY INSTRUCTIONS
    • DISTURBING GROUP DISCIPLINE
  • THE TREK LEADER’S DECISION IS FINAL AND BINDING.
  • REMOVED PARTICIPANTS MUST MANAGE THEIR RETURN TRAVEL AT THEIR OWN EXPENSE AND WILL BE PERMANENTLY BLACKLISTED.

CLAUSE 9 — IDENTIFICATION, DOCUMENTATION, AND PERMIT RULES

  • VALID GOVERNMENT PHOTO ID IS MANDATORY
  • FAILURE TO PROVIDE ID RESULTS IN DENIED PARTICIPATION WITHOUT REFUND
  • ALL REQUIRED DOCUMENTS MUST BE SUBMITTED BEFORE DEADLINE
  • PERMIT APPROVAL IS SOLELY UNDER GOVERNMENT AUTHORITIES
  • THE COMPANY IS NOT LIABLE FOR PERMIT DENIAL OR DELAY

CLAUSE 10 — INSURANCE, MEDICAL DISCLOSURE, AND HEALTH RESPONSIBILITY

  • TRAVEL & MEDICAL INSURANCE IS MANDATORY
  • ALL MEDICAL CONDITIONS MUST BE DISCLOSED AT BOOKING
  • FAILURE TO DISCLOSE HEALTH INFORMATION WILL RESULT IN REMOVAL WITHOUT REFUND
  • ALL MEDICAL, HOSPITAL, OR EVACUATION COSTS ARE THE CLIENT’S RESPONSIBILITY
  • PARTICIPATION IN ANY TREK/TRIP IS AT THE CLIENT’S OWN RISK
  • THE COMPANY IS NOT LIABLE FOR AMS, FATIGUE, ALLERGIC REACTIONS, OR ALTITUDE-RELATED ILLNESS

CLAUSE 11 — MINOR PARTICIPATION AND GUARDIAN LIABILITY

  • PARTICIPANTS UNDER 18 MUST BE ACCOMPANIED BY A PARENT/LEGAL GUARDIAN
  • GUARDIAN IS FULLY RESPONSIBLE FOR MINOR’S SAFETY, BEHAVIOR, HEALTH, AND CONDUCT
  • NO SPECIAL ACCOMMODATION OR EXCEPTIONS ARE PROVIDED FOR MINORS

CLAUSE 12 — TECHNICAL DISRUPTIONS AND SYSTEM FAILURES

  • THE COMPANY IS NOT RESPONSIBLE FOR:
    • WEBSITE ERRORS
    • INTERNET ISSUES
    • PAYMENT GATEWAY FAILURE
    • SERVER OUTAGES
    • THIRD-PARTY TECHNICAL ISSUES
  • NO COMPENSATION OR REFUND WILL BE PROVIDED.

CLAUSE 13 — MAXIMUM LIABILITY AND RISK LIMITATION

  • THE MAXIMUM LEGAL LIABILITY OF THE COMPANY IS LIMITED ONLY TO THE TOTAL AMOUNT PAID BY THE CLIENT.
  • THE COMPANY IS NOT LIABLE FOR:
    • INDIRECT LOSS
    • EMOTIONAL LOSS
    • EXTRA EXPENSES
    • WEATHER ISSUES
    • NATURAL EVENTS
    • ROAD DELAYS
    • GOVERNMENT ORDERS
    • UNFORESEEN SITUATIONS
    • ANY EVENT BEYOND CONTROL

CLAUSE 14 — PAYMENT REFUND SOURCE AND SECURITY

  • REFUNDS (IF APPLICABLE) WILL BE SENT ONLY TO THE ORIGINAL PAYMENT SOURCE.
    NO THIRD-PARTY ACCOUNT, CASH, OR ALTERNATE METHOD WILL BE ALLOWED.
  • INCORRECT BANK DETAILS PROVIDED WILL DELAY OR INVALIDATE REFUNDS.

CLAUSE 15 — ITINERARY, HOTEL, TRANSPORT, AND LOGISTICS CHANGES

  • FOR SAFETY OR OPERATIONAL REASONS, THE COMPANY MAY MODIFY:
    • ITINERARY
    • ROUTE
    • HOTEL
    • TRANSPORT
    • TIMINGS
    • ACTIVITIES
  • NO REFUND OR COMPENSATION WILL BE PROVIDED FOR THESE CHANGES.
  • ARRIVING LATE TO THE PICKUP POINT RESULT IN NO-SHOW, WITH NO REFUND.

CLAUSE 16 — EQUIPMENT DAMAGE AND LOSS POLICY

  • THE CLIENT IS FULLY RESPONSIBLE FOR ANY LOSS OR DAMAGE TO EQUIPMENT PROVIDED BY THE COMPANY.
  • THE COMPANY’S DAMAGE COST ASSESSMENT IS FINAL.

CLAUSE 17 — CLEANLINESS, ENVIRONMENTAL RESPONSIBILITY, AND LOCAL RESPECT

  • CLIENTS MUST MAINTAIN CLEANLINESS, RESPECT LOCAL CULTURE, AVOID LITTERING, AND FOLLOW ECO-GUIDELINES.
  • VIOLATION MAY RESULT IN REMOVAL WITHOUT REFUND.

CLAUSE 18 — TRANSPORTATION CONDITIONS AND NON-GUARANTEES

  • THE COMPANY IS NOT RESPONSIBLE FOR:
    • SEAT PREFERENCE
    • WINDOW SEAT
    • AC/NON-AC OPERATION
    • VEHICLE MODEL/VARIANT
    • BACKUP VEHICLE REPLACEMENT
    • TRAFFIC DELAYS
    • LUGGAGE SPACE LIMITATIONS
    • TEMPORARY TRANSPORT CHANGE
  • NO REFUND IS PROVIDED FOR ANY TRANSPORT ADJUSTMENT.

CLAUSE 19 — FOOD, MEALS, AND DIETARY LIMITATIONS

  • THE COMPANY IS NOT RESPONSIBLE FOR:
    • FOOD ALLERGIES
    • DIETARY RESTRICTIONS
    • PICKY EATING
    • PERSONAL FOOD PREFERENCES
    • OVEREATING OR UNDEREATING
  • MEALS PROVIDED ARE STANDARD AND CANNOT BE CUSTOMIZED.

CLAUSE 20 — BELONGINGS, VALUABLES, AND PERSONAL ITEMS

  • CLIENTS ARE FULLY RESPONSIBLE FOR THEIR OWN BELONGINGS.
  • THE COMPANY IS NOT LIABLE FOR LOSS, THEFT, OR DAMAGE TO PERSONAL ITEMS.

CLAUSE 21 — INDEMNITY AND SELF-RESPONSIBILITY CLAUSE

  • THE CLIENT AGREES TO INDEMNIFY AND HOLD THE COMPANY HARMLESS AGAINST ANY CLAIMS, DAMAGES, LIABILITY, LOSS, OR INJURY RESULTING FROM:
    • THEIR OWN ACTIONS
    • HEALTH ISSUES
    • NEGLIGENCE
    • MISCONDUCT
    • IGNORING INSTRUCTIONS
    • FAILURE TO MAINTAIN FITNESS
    • MISUSE OF EQUIPMENT

CLAUSE 22 — SAFETY EQUIPMENT USAGE COMPLIANCE

  • CLIENTS MUST FOLLOW ALL INSTRUCTIONS REGARDING SAFETY GEAR, CLOTHING, AND EQUIPMENT.
  • THE COMPANY IS NOT LIABLE FOR INJURIES CAUSED BY MISUSE OR NON-COMPLIANCE.

CLAUSE 23 — PERSONAL VEHICLE LIABILITY

  • IF A CLIENT TRAVELS USING THEIR PERSONAL VEHICLE (CAR/BIKE):
    • THE COMPANY IS NOT RESPONSIBLE FOR BREAKDOWNS, ACCIDENTS, OR DELAYS
    • NO REFUND OR SUPPORT IS PROVIDED IF A CLIENT MISSES THE GROUP DUE TO VEHICLE ISSUES

CLAUSE 24 — NETWORK, SIGNAL, AND CONNECTIVITY LIMITATION

  • MOBILE NETWORK, WIFI, AND INTERNET CONNECTIVITY CANNOT BE GUARANTEED AT ANY LOCATION.
  • THE COMPANY IS NOT RESPONSIBLE FOR LACK OF NETWORK ACCESS.

CLAUSE 25 — NO GUARANTEE OF WEATHER, SIGHTINGS, OR NATURAL CONDITIONS

  • THE COMPANY DOES NOT GUARANTEE:
    • SNOW
    • VIEWS
    • WEATHER CONDITIONS
    • WILDLIFE SIGHTINGS
    • SEASONAL FEATURES
    • LOCAL EVENTS OR FESTIVALS
  • NO REFUND WILL BE PROVIDED IF CONDITIONS DIFFER FROM CLIENT EXPECTATIONS.

CLAUSE 26 — FINAL DISPUTE RESOLUTION AND LEGAL JURISDICTION

  • ANY DISPUTE MUST FIRST BE REPORTED THROUGH A WRITTEN EMAIL TO: INFO@THETREKKERSTRAIL.COM
  • THE COMPANY WILL BE GIVEN 30 DAYS TO REVIEW AND RESPOND.
  • IF UNRESOLVED, THE CLIENT AGREES THAT ALL LEGAL PROCEEDINGS SHALL BE EXCLUSIVELY FILED IN: MANSA, GUJARAT OR GANDHINAGAR, GUJARAT
  • NO OTHER CITY, STATE, OR COURT SHALL HAVE JURISDICTION.
  • THE CLIENT WAIVES ANY OBJECTION REGARDING VENUE OR JURISDICTION.
